When it comes to workers’ compensation, every settlement is a little different which means when a person receives their actual settlement check, it often varies. It’s not simply a rule that you will receive “x” amount of dollars “y” number of days following your injuries. The process is a little bit more complex – but the good news is it’s all for your benefit!
Negotiating More Money
While workers’ compensation may be a right, there are still plenty of ways for insurance providers, employers, and other entities involved to prevent you from getting everything you’re entitled too, including simply not telling you about assistance you qualify for and could really benefit from. This is why having workers’ compensation attorneys is so important. However, the more money you’re entitled to, the harder others will fight back to keep you from getting it, which means how long it actually takes to arrive at a fair settlement figure will all depend on the specifics of your case, and the quality of your representation. The most important thing to remember is, our attorneys at Aiello Law Group will always fight for your right to maximum compensation!
Redemption Hearings
Michigan law requires all employees to hold off on their settlements until at least 6 months from the date of their injury to ensure medical stability. Settlements are then considered and later approved by a magistrate at what is known as a redemption hearing after they have been able to adequately review the case and formulate a judgment.
Appeals
It takes 15 days for a settlement to become final, leaving plenty of time to appeal so long as there is just cause. A waiver for this 15-day period can be requested in order to receive your check sooner. Just know, both parties, meaning you and your employer/insurance, must agree to this in order for a settlement to skip the waiting period and become final straightaway.
Settlement Delivery
Settlement checks are more often than not sent through the standard mail service, also commonly known as “snail mail.” This means it’s not a far leap to assume that even after your settlement has been approved, it can still take some time for you to actually receive those funds – and delays can happen. If your settlement is due and it’s been more than two weeks, you may even want to follow up with your insurance provider to make sure it didn’t get forgotten about on someone’s desk.
