Redemption Hearings
Michigan law requires all employees to hold off on their settlements until at least 6 months from the date of their injury to ensure medical stability. Settlements are then considered and later approved by a magistrate at what is known as a redemption hearing after they have been able to adequately review the case and formulate a judgment.
Appeals
It takes 15 days for a settlement to become final, leaving plenty of time to appeal so long as there is just cause. A waiver for this 15-day period can be requested in order to receive your check sooner. Just know, both parties, meaning you and your employer/insurance, must agree to this in order for a settlement to skip the waiting period and become final straightaway.
Settlement Delivery
Settlement checks are more often than not sent through the standard mail service, also commonly known as “snail mail.” This means it’s not a far leap to assume that even after your settlement has been approved, it can still take some time for you to actually receive those funds – and delays can happen. If your settlement is due and it’s been more than two weeks, you may even want to follow up with your insurance provider to make sure it didn’t get forgotten about on someone’s desk.
